Human rights related to the Objectives of Islamic law

Abstract

This research deals with the topic of the objectives of Islamic law and human rights, as these rights in Islam are eternal rights, which God Almighty has prescribed, their source is the Book of God Almighty and the Sunnah of His Prophet, and they are fully consistent with the objectives of Islamic law, which came to preserve the five necessities: Self, Religion, Mind, Seed, and Money.

This research aims to demonstrate the relevance of human rights to the purposes of Islamic law, and that what contradicts the provisions of Islamic law is not considered human rights, even if on the surface it is the realization of an immediate human interest, and that the real interest cannot be in opposition to the purposes of Islamic law.

The research began by defining the objectives in rhetoric and idiomatically, defining the objectives of Islamic law, stating the importance of knowing the objectives and their benefits, and dividing the objectives according to interests into: Necessary, necessary, and ameliorative, and clarifying the legitimate means to achieve the objectives and rights.

A set of results were reached, the most important of which are: The objectives of Islamic law are the true basis and the correct starting point for achieving human rights and achieving happiness for the human being in the two worlds, and that Islamic law aims to bring benefits and ward off evil, and to preserve human rights without discrimination, so that everyone can secure himself, his money and his honor.

Among the most important recommendations: That Muslims must stand up to the objectives of Islamic law, understand it and its awareness, and not allow any prejudice to the five necessities, adhere to the law of God Almighty and move away from every forbidden argument under the pretext that it serves an interest.
